01 Scope

These Website Terms & Submission Terms govern access to and use of the Margin Architecture website, including public pages, embedded forms, intake submissions, downloads, and any related communications initiated through the site. The site is operated by A. Rojas, doing business as Margin Architecture.

02 What the website is — and is not

The website is provided for general informational and business-development purposes. It describes Margin Architecture's advisory methodology and intake process, but it does not itself create a client relationship, fiduciary duty, advisory mandate, or engagement commitment. No person becomes a client merely by browsing the site, submitting an intake form, sending a message, or receiving a response.

03 No professional reliance

Website content is not legal, tax, accounting, audit, investment, employment, or other professional advice directed to your specific circumstances. The site may discuss financial architecture, decision integrity, structural diagnostics, or related business issues, but no website content should be treated as a substitute for a signed engagement and tailored professional analysis.

04 Intake and submission rules

Any form or message submitted through the website is an initial business inquiry only. Do not submit sensitive personal data, patient data, government identifiers, passwords, banking credentials, trade secrets you are not authorized to disclose, or confidential third-party files unless and until Margin Architecture expressly requests them within a protected engagement process. Submissions may be reviewed for fit, routing, qualification, conflict screening, and internal recordkeeping. Margin Architecture may decline to respond, may qualify out an inquiry, or may request a more appropriate next step.

05 No confidentiality created by website submission alone

Website submissions and pre-engagement communications are not automatically confidential, privileged, or protected by nondisclosure obligations unless a separate written confidentiality agreement is executed or Margin Architecture expressly confirms a protected channel for the relevant exchange. You should therefore limit submissions to information reasonably necessary for initial evaluation.

06 Acceptable use

You agree not to misuse the website, interfere with its operation, attempt unauthorized access, introduce malicious code, harvest data, impersonate any person, submit false or misleading information, or use the site in violation of applicable law. You may not use the website or its content to train competing systems, replicate the methodology, or reverse engineer protected materials.

07 Intellectual property

The website, its structure, text, branding, visual presentation, methodology descriptions, product architecture, and related materials are owned by or licensed to Margin Architecture unless otherwise stated. No transfer of intellectual property occurs through website access. You may view the site for your own internal evaluation, but you may not copy, republish, distribute, modify, frame, scrape, or commercially exploit website content except with prior written permission.

08 Third-party services

To the maximum extent permitted by applicable law, Margin Architecture and A. Rojas shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, business opportunity, revenue, profits, or goodwill arising out of or related to website use, inability to use the website, or reliance on website content. Where liability cannot be excluded, it will be limited to the smallest amount permitted by applicable law.

13 Changes

Margin Architecture may revise these Terms from time to time. The updated version becomes effective when posted on the website unless a later effective date is stated. Continued use of the website after an update constitutes acceptance of the revised Terms.

14 Language

These Terms may be published in English and Spanish. Margin Architecture intends both versions to communicate the same substantive rules. If a material inconsistency arises, the English version will control unless mandatory applicable law requires otherwise.

15 Governing law and forum

Unless mandatory law requires a different result, these Terms are governed by the laws of Colombia. Any dispute arising from or relating to the website or these Terms shall be submitted to the competent courts of Bogotá, D.C., Colombia.

02 Qué es el sitio — y qué no es

El sitio se ofrece con fines informativos generales y de desarrollo comercial. Describe la metodología e intake de Margin Architecture, pero por sí solo no crea una relación cliente-profesional, un deber fiduciario, un mandato de asesoría ni un compromiso de engagement. Nadie se convierte en cliente solo por navegar el sitio, enviar un formulario, mandar un mensaje o recibir una respuesta.

03 Sin confianza profesional específica

El contenido del sitio no constituye asesoría legal, tributaria, contable, de auditoría, inversión, laboral ni otra asesoría profesional aplicada a circunstancias específicas. Aunque el sitio puede tratar temas de arquitectura financiera, decision integrity o diagnósticos estructurales, ningún contenido del sitio debe tomarse como sustituto de un engagement firmado y de un análisis profesional adaptado al caso.

04 Reglas para formularios y envíos

Cualquier formulario o mensaje enviado a través del sitio constituye únicamente una consulta inicial de negocio. No envíe datos personales sensibles, datos de salud, identificaciones oficiales, contraseñas, credenciales bancarias, secretos empresariales que no esté autorizado a revelar ni archivos confidenciales de terceros, salvo que Margin Architecture lo solicite expresamente dentro de un proceso de engagement protegido. Los envíos pueden ser revisados para evaluar encaje, ruta, calificación, conflictos y registro interno. Margin Architecture puede no responder, puede descartar la consulta o puede indicar un siguiente paso más apropiado.

05 La sola presentación web no crea confidencialidad

Los envíos hechos por el sitio y las comunicaciones previas al engagement no son automáticamente confidenciales, privilegiados ni están protegidos por obligaciones de no divulgación, a menos que exista un acuerdo escrito separado de confidencialidad o que Margin Architecture confirme expresamente un canal protegido para ese intercambio. Por ello, limite sus envíos a la información razonablemente necesaria para la evaluación inicial.

06 Uso aceptable

Usted se obliga a no hacer uso indebido del sitio, interferir con su operación, intentar accesos no autorizados, introducir código malicioso, extraer datos de forma indebida, suplantar a otra persona, enviar información falsa o engañosa, ni utilizar el sitio en violación de la ley aplicable. Tampoco podrá usar el sitio o su contenido para entrenar sistemas competidores, replicar la metodología o realizar ingeniería inversa sobre materiales protegidos.

07 Propiedad intelectual

El sitio, su estructura, textos, marca, presentación visual, descripciones metodológicas, arquitectura de productos y materiales relacionados pertenecen a Margin Architecture o se usan bajo licencia, salvo que se indique lo contrario. El acceso al sitio no transfiere propiedad intelectual alguna. Usted puede consultar el sitio para su evaluación interna, pero no puede copiar, republicar, distribuir, modificar, enmarcar, extraer ni explotar comercialmente su contenido sin autorización previa y escrita.

08 Servicios de terceros

El sitio puede depender de infraestructura y sistemas empresariales de terceros, incluidos servicios de hosting, analítica, correo, productividad y procesamiento de formularios. En la máxima medida permitida por la ley aplicable, Margin Architecture y A. Rojas no serán responsables por daños indirectos, incidentales, especiales, consecuenciales, ejemplares o punitivos, ni por pérdidas de datos, oportunidades de negocio, ingresos, utilidades o reputación derivadas del uso del sitio, de la imposibilidad de usarlo o de la confianza depositada en su contenido. Cuando la responsabilidad no pueda excluirse, se limitará al menor monto permitido por la ley aplicable.

13 Cambios

Margin Architecture podrá modificar estos Términos periódicamente. La versión actualizada entrará en vigor cuando se publique en el sitio, salvo que se indique una fecha posterior. El uso continuado del sitio después de una actualización constituye aceptación de los Términos revisados.

14 Idioma

Estos Términos podrán publicarse en inglés y en español. Margin Architecture procura que ambas versiones expresen las mismas reglas sustanciales. Si surge una inconsistencia material, prevalecerá la versión en inglés salvo que una norma imperativa exija lo contrario.

15 Ley aplicable y foro

Salvo que una norma imperativa exija un resultado distinto, estos Términos se regirán por las leyes de Colombia. Cualquier disputa relacionada con el sitio o con estos Términos será sometida a los jueces competentes de Bogotá, D.C., Colombia.
